General conditions of services

1. Introduction and scope

These General Terms and Conditions of Services (hereinafter referred to as "GTS") define the rights and obligations between Facile Solution SRL (hereinafter referred to as the "Publisher") and the Subscriber (hereinafter referred to as the "Subscriber") concerning the provision of pay services accessible via the website Hivwear.com (hereinafter "the Site").

The GTS apply to all Subscriptions taken out by natural persons of legal age residing in eligible territories. They are accessible on the Site and may be modified unilaterally by the Publisher. Any modification will be notified one (1) month prior to its application.

2. Definitions

  • Subscriber Any natural person aged 18 or over who has taken out a Subscription on a personal basis.
  • Subscription Contract between the Subscriber and the Publisher giving access to the Specific Services after payment.
  • Specific Services Benefits and functionalities detailed in article 4, including access to the Press Kiosk and other exclusive benefits.
  • Account Personal space created by the Subscriber on the Site, secured by a login and password.
  • Personal data Information collected and processed in accordance with the Confidentiality Policy.
  • Press Kiosk Digital catalogue including press, magazines and novels accessible via a third-party partner.

3. Description of Specific Services

The Subscription offers :

  1. Unlimited access to the Press Kiosk
    • Continuously updated digital catalogue supplied by a third-party partner (YouScribe).
    • No physical books are distributed.
  2. Exclusive benefits for members
    • Discounts of up to 50 % on the online shop.
    • Free delivery on all products.
  3. Details and availability
    • The Specific Services are accessible exclusively via the Subscriber's personal Account.
    • Confirmation of login and password by e-mail on subscription.

4. Subscription process

  1. Creating an account
    • Subscribers must enter their personal details (e-mail address, password, other information).
    • Only one entry per person is permitted.
    • The Subscriber is responsible for updating his contact details.
  2. Subscription validation
    • Subscription via the Site, after logging into the Account.
    • Acceptance of the T&Cs by ticking the appropriate box.
    • Secure payment by credit card (CB, Visa, MasterCard).
  3. Confirmation
    • A confirmation e-mail will be sent once payment has been confirmed.

5. Duration and Termination of the Subscription

  1. Initial Term and Renewal
    • The Subscription is concluded for a period of 30 days, tacitly renewable each month.
  2. Cancellation procedure
    • Notification via the Site's contact form or by e-mail (contact@Hivwear.com).
    • To cancel at the end of the current month, the request must be received by the 15th of the month.
    • If a direct debit has already been made, access to Specific Services remains active until the end of the following month.
  3. Suspension or Early Termination by the Publisher
    • In the event of non-compliance with the GTS (fraud, non-payment, etc.), the Publisher may suspend or terminate the Subscription immediately, without compensation.

6. Prices and payment

  1. Applicable rates
    • Trial period: 3 days
    • Monthly subscription : 45,90 €
  2. Payment methods
    • Payment by credit card only. Payments via PayPal or American Express are not accepted.
  3. Price review
    • The Publisher reserves the right to change the prices with two (2) months' notice.
    • The Subscriber may cancel without charge if he disagrees with the new tariff.
  4. Payment undertaking
    • The Subscriber guarantees the validity of his/her means of payment and accepts monthly direct debits.

7. Availability of Services

The Specific Services are accessible immediately after validation of payment, from the Subscriber's personal Account. The Publisher does not guarantee uninterrupted availability and accepts no liability for temporary interruptions due to maintenance operations.

8. Right of Withdrawal

  1. Time limit and Exercise
    • The Subscriber has 14 days to exercise his right of withdrawal.
    • Notification via Withdrawal Form (Appendix 1) by e-mail or post.
  2. Conditions
    • If the Subscriber has requested immediate access to the Services, he/she must pay an amount proportional to the actual use of the Services up to the date of withdrawal.

9. Personal data

The data collected is processed in accordance with the Confidentiality Policies. Subscribers have the right to access, modify and delete their personal data.

11. Miscellaneous provisions

  1. Electronic correspondence
    • Communications by e-mail are authoritative between the parties.
  2. Partial Non-Validity
    • If any clause of the GTS is found to be invalid, the other clauses shall remain in force.

12. Applicable law and disputes

The GCS are governed by Belgian law. In the event of a dispute :

  1. Attempt amicable mediation within one (1) year via an approved mediator.
  2. If no agreement is reached, recourse to the competent courts.
