1. Presentation and scope

These General Terms and Conditions of Sale (GTCS) define the rights and obligations of Facile Solution SRL (hereinafter "the Publisher") and the customer (hereinafter "the Customer") concerning the sale of products offered on the website Hivwear.com (hereinafter "the Site").

These GTC are accessible on the Site and may be modified at any time. Any changes will be notified to the Customer before an order is validated.

2. Definitions

  • Customer Any individual aged 18 or over who places an order on the Site for strictly personal use.
  • Product(s) Items offered for sale on the Site.
  • Ordering Purchase of Products made on the Site by the Customer.
  • Withdrawal form The document enabling the Customer to exercise his right of withdrawal, attached as an appendix to these General Terms and Conditions of Sale.
  • Publisher Facile Solution SRL, operator and publisher of the Site.

3. Product characteristics

The main characteristics of the Products (description, price, images) are detailed on the Site in their respective data sheets.

Availability :

  • Products are sold while stocks last.
  • In the event of unavailability, the Customer will be informed by e-mail and reimbursed within 30 days.

4. Geographical area

Orders and deliveries are limited to mainland France, Corsica and Monaco. Orders outside this area will not be honoured.

5. Ordering process

  1. Add to basket

    • The Customer selects the desired Products and adds them to their basket.

  2. Identification

    • Customers must create an account or log in to validate their order.

  3. Order validation

    • Before finalising the order, the Customer must check the information entered, accept these GTCs and then make the payment via a secure platform.

  4. Order Confirmation

    • Written confirmation will be sent by e-mail as soon as the order has been confirmed.
    • An additional e-mail will be sent to notify you that the Products have been dispatched.

6. Prices and payment

  • Prices Prices are quoted in euros, inclusive of all taxes.
  • Payment methods :
    • Payment by credit card (CB, Visa, MasterCard).
    • Other payment methods, such as PayPal or American Express, are not accepted.
  • Securing Payments are made via a secure third-party platform. The Publisher never stores the Customer's bank details.

7. Delivery

  1. Terms of delivery

    • Delivery is deemed to have taken place when the parcel is handed over to the Customer or to a designated third party.

  2. Deadlines

    • All orders are dispatched within 48 hours.
    • The estimated delivery time is between 4 and 6 working days from dispatch of the order.
    • If the deadline is exceeded by more than 30 days, the Customer may cancel the order and obtain a full refund.

  3. Reservations and complaints

    • The Customer must check the condition of the parcel on receipt and report any anomaly (open or damaged parcel) within 3 working days of delivery, by registered letter addressed to the carrier with a copy to the Publisher.

  4. Delivery costs

    • Delivery costs are specified when the order is confirmed.

8. Right of Withdrawal

In accordance with article L.221-18 et seq. of the French Consumer Code, the Customer has 30 clear days in which to exercise his right of withdrawal.

Terms and conditions :

  • The Customer must notify his decision by completing the withdrawal form (Appendix 1) and sending it by e-mail or post.
  • The Product(s) must be returned to the Publisher within 30 days, in perfect condition and in their original packaging.
  • The cost of returning the goods shall be borne by the Customer.

Refund :

  • The Publisher will refund the price of the Products, as well as the standard delivery costs, within 14 days of receipt of the returned Products.

9. Guarantees

  1. Legal Warranty of Conformity

    • Valid for 2 years from delivery. The Customer may request repair or replacement of the Product.

  2. Hidden Defects Guarantee

    • Allows you to request a refund or price reduction in the event of a hidden defect.

10. Personal Data

The Customer's personal data is collected and processed in accordance with the Privacy Policy.

12. Miscellaneous provisions

  1. Proof

    • Electronic communications between the Publisher and the Customer are binding.

  2. Partial validity

    • If any provision of the GTC is found to be invalid, the other provisions shall remain in force.

  3. Securities

    • The titles of the articles are indicative and do not affect the interpretation of the GTCS.

13. Disputes

The GCS are governed by Belgian law. In the event of a dispute, the Customer may :

  • Request amicable mediation.
  • Bring the matter before the appropriate courts.
