General Terms of Sale

1. Introduction and scope

These General Terms of Sale (GTS) set out the rights and obligations of Facile Solution SRL (hereinafter the “Publisher”) and the customer (hereinafter the “Customer”) regarding the sale of products offered on the website Hivwear.com (hereinafter the “Site”).

The GTS are available on the Site and may be amended at any time. Any amendment will be brought to the Customer’s attention before an order is confirmed.

2. Definitions

  • Customer: Any natural person aged at least 18 who places an order on the Site for strictly personal use.
  • Product(s): Items offered for sale on the Site.
  • Order: Purchase of Products by the Customer on the Site.
  • Withdrawal form: Document enabling the Customer to exercise their right of withdrawal, attached as an annex to these GTS.
  • Publisher: Facile Solution SRL, operator and publisher of the Site.

3. Product characteristics

The main characteristics of the Products (description, price, images) are detailed on the Site on their respective pages.

Availability:

  • Products are sold subject to available stock.
  • If a Product is unavailable, the Customer will be informed by email and refunded within 30 days.

4. Geographic area

Orders and deliveries are limited to metropolitan France, Corsica and Monaco. Any order outside this area cannot be fulfilled.

5. Order process

  1. Add to cart

    • The Customer selects the desired Products and adds them to the cart.

  2. Identification

    • The Customer must create an account or log in to confirm the order.

  3. Order validation

    • Before completing the order, the Customer must check the information entered, accept these GTS, then pay via a secure platform.

  4. Order confirmation

    • Written confirmation is sent by email once the order is validated.
    • A further email is sent when the Products are shipped.

6. Price and payment

  • Prices: Prices are stated in euros, inclusive of all taxes (VAT included).
  • Payment methods:
    • Payment by bank card (debit card, Visa, MasterCard).
    • Other methods such as PayPal or American Express are not accepted.
  • Security: Payments are processed via a secure third-party platform. The Customer’s bank details are never stored by the Publisher.

7. Delivery

  1. Delivery arrangements

    • Delivery is deemed completed when the parcel is handed to the Customer or a third party designated by them.

  2. Timeframes

    • All orders are shipped within 48 hours.
    • Estimated delivery time is between 4 and 6 business days from shipment.
    • If the deadline is exceeded by more than 30 days, the Customer may cancel the order and obtain a full refund.

  3. Reservations and claims

    • The Customer must check the condition of the parcel on receipt and report any anomaly (open or damaged parcel) within 3 business days of delivery, by registered letter to the carrier with a copy to the Publisher.

  4. Delivery charges

    • Delivery charges are stated when the order is confirmed.

8. Right of withdrawal

Clarifications: return shipping costs are borne by the customer. After notifying your withdrawal within the applicable period, you have 14 days to return the product(s) to us. The refund is issued once we have received and checked the returned items. Personalised or made-to-order products are excluded from the right of withdrawal.

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Customer has 30 clear days to exercise their right of withdrawal.

How to exercise it:

  • The Customer must notify their decision by completing the withdrawal form (Annex 1) and sending it by email or post.
  • The Product(s) must be returned to the Publisher within 30 days, in perfect condition.
  • For defective or non-conforming products, we cover return shipping costs. For any other reason, return shipping costs are borne by the customer. We recommend using a tracked delivery service to ensure your return is received.

Refund:

  • The Publisher will refund the price of the Products and standard delivery charges within 14 days of receiving the returned Products.

9. Warranties

  1. Legal conformity warranty

    • Valid for 2 years from delivery. The Customer may request repair or replacement of the Product.

  2. Warranty for hidden defects

    • Allows the Customer to request a refund or price reduction in the event of a hidden defect.

10. Personal data

The Customer’s personal data are collected and processed in accordance with the Privacy Policy.

12. Miscellaneous

  1. Evidence

    • Electronic communications are binding between the Publisher and the Customer.

  2. Partial validity

    • If any provision of the GTS is held invalid, the remaining provisions remain applicable.

  3. Headings

    • Section headings are for convenience only and do not affect the interpretation of the GTS.

13. Disputes

The GTS are governed by Belgian law. In the event of a dispute, the Customer may:

  • Seek an amicable mediation solution.
  • Bring proceedings before the competent courts.
